1730 doth come here into Kent County Court before William Frisby Esq.r and his associates his Lord ships Justices of the Same County Court to wit at Chester Town in the afd County the day of August Anno Dom. Seventeen hundred and thirty and for the Same Lord prop.ry doth give the Court here to understand and be informed that William Bourkham late of S.t pauls parish in the County afd labourer the tenth day of July Anno Dom. one thousand Seven hundred and thirty at the parish afd in the County afd within the Jurisdicon of this Court in and upon Thomas with force and Armes an assault did make and him the Said Thomas then and there did beat wound and evilly treat So that of his life it was much dispared and other harms to him then and there did to the great damage of the Same Thomas & against the peace of the Same Lord prop.ry his good rule and and government wherefore the afd attorney prayeth the advice of the Court herein the premisses for the Lord prop.ry and due process of Law against the afd William in this part to Issue to answer to the ^Said^ Lord prop.ry of and upon the premisses &c.a And the afd Will.m Bourkham in his proper person cometh here into Court and Saith that he cannot gainsay the premisses afd So as afd against him bro.t nor but that he is guilty of the premisses above upon him Imposed as by the afd Information it is alledged and thereupon Submits to the Court Therefore it is Considered by the Justices here to wit at the Court House in the Town of Chester in Said County on the third tuesday in Aug.st being the Eighteenth day of Said Month Anno Dom. Seventeen hundred and thirty That the afd William Bourkham pay the Sume of five hundred pounds of Tobacco as a fine to the right honourable the Lord prop.ry for Committing of the assault afd as afd Confest And also pay the Sum of two hundred forty two pounds of Tobacco Costs accrueing on the premisses afd to the officers of this Court Jam.s Smith Clk Ordered by the Court here that Joseph Young Gent high Sherf of Said Coty keep the afd William Bourkham in Safe Custody untill the fine and fees afd Shall be Satisfied Whereas the afd William Bourkham on the fifth day of July last ent.rd into Recognizance before M.r John Evans one of his Lord Ships Justices of the peace for the afd Kent County for his appearance to this Court The afd Thomas in his proper person here in Court appears and answers Same Ordered by this Court that the Same be disch.d This Court here discharges the Same Recognizance being in the Sume of ten pounds Sterl for the appearance of the afd William Bourkham and John True his Security at the Same time in the Sum of five pounds Sterling as by this Court also discharged No person Shewing any cause to y.e Contrary This Court ordered that the Clerk of the Indictments Should Exhibited an Information against the afd William on the afd Acco.t which was done as above &c.a it was ordered also That Cap.s Issue ag.t Same |
