of the right Honourable the Lord prop.ry that now is for the County afd also for the Same Lord prop.ry in this part prosecuteth doth come hereinto Kent County Court before William Frisby Esq.r and his Associates his Lordships Justices of the Same County Court to wit at Chest.r Town in the afd County the day of August Anno Dom. Seventeen hundred and thirty and for the Same Lord prop.ry doth give the Court here to understand and be informed that Samuel Cooke of S.t pauls parish in the County afd Taylor the tenth day of July Anno Dom. Seventeen hundred and thirty at the parish afd in the County afd within the Jurisdiscon of this Court in and upon John Bath in the peace of Gosd and the Said Lord prop.ry then and there being with force and Arms an assault did make on him the Said John then and there did beat wound and evilly treat So that his life it was dispared and the harms to him did to the great damage of the Said John and Contrary to the peace of the Same Lord prop.ry his good rule and Government &c.a Wherefore the afd attorney prayeth the advice of the Court here in the premisses for the Said Lord prop.ry and due process of Law against the afd Samuel in this part to Issue to answer to the said Lord prop.ry of and upon the premisses &c.a Thereupon this Court ordered that Capias issue against the afd Sam.l on the Information afd But now here came the afd Samuel Cooke and Saith that he cannot gainsay the Information afd So as afd against him brought nor but that he is guilty of the premisses afd above upon him Imposed as by the afd Information it is alledged and thereupon Submits to the Court Therefore it is Considered by the Justices here to wit Att the Court House in the Town of Chester in Said County on the third tuesday in August being the Eighteenth day of Said Month Anno Dom. Seventeen hundred and thirty That the afd Samuel Cooke pay the Sum of One hundred pounds of Tobacco as a fine to the right honourable the Lord prop.ry for Committing of the assault afd as afd Confest And also pay the Sum of two hundred fifty nine pounds of Tobacco Costs accrueing on the premisses afd to the officers of this Court Jam.s Smith Clk Ordered by the Court here that Joseph Young Gent high Sherf of Kent County keep the afd Samuel Cooke in Safe Custody untill the fine and fees afd Shall be Satisfied Thereupon came into Court M.r Charles Hynson of Said County and Saith that he will pay the fine and fees afd to whom they belong and the Said Samuel is disch.d Whereas the afd Samuel on the Seventeenth day of July last entered into Recognizance befor the afd Charles Hynson Gent one of the Lord prop.rys Justices of the peace for the afd County for his appearance to this p.rsent Cort &c.a And the afd Samuel in his proper person comes and appears all afd Recognizance &c. Ordered by the Court here that the Same |
