143 The Same Joseph Sanders being Indicted And the Same Indictm.t being for Stealing of three Shirts the goods & Chattles of a Certain Thomas Hatchenson to which the Same Joseph pleaded not guilty &c.a And alledged that he was not ready for his tryal and pray'd that the Same Indictm.t might be cont.d untill the then next Court in Cause is ord.rd for him to prepare himselfe for his Tryal to which the Court Consented upon his giveing Security for his app.rc to the Said Court to Answer the Same And upon which the afd Joseph Sanders in his pper pson comes into Court and Acknowledged himselfe Indebted to the Right Hon.rble the Ld propry in the Sum of twenty pds Sterl to be Leveyd on his body goods & Chattles Lands and Tenements to the use of his Said Lordship his heires and Successors Conditionally that if at the next Court to be held for Said County on the third Tuesday in August next to Answer unto y.e Same Indictment of felony as afd And that in the mean time he is to be of good behav.r wherewith he acknowledges himselfe to be therewith Content Also at the Same time came Ellis Foulks of the afd Kent County planter and in his proper pson acknowledged himselfe Indebted to the Right Hon.rble the Lord proprietarie in the Sum of twenty pounds Sterl to be Leveyed on his body goods and Chattles Lands and Tenements to the use of his Said Lord Ship his heires & Successors Conditionally that if the Said Joseph Sanders Shall not appear at the next County Court to be held at the Court House in the town of Chest.r in Said County on the third tuesday in August next to Answ.r unto the afd Indictm.t of felony as afd and that in the mean time the Said Joseph Sanders is to be of good behav.r wherewith the Said Ellis Foulks Acknowledges himselfe Content Ordered by the Court here that Thomas Hatchenson enter into Recognizance as psecut.r to the afd cause Thereupon comes into Court the afd Thomas Hatchenson and in his pper pson and acknowledged himselfe Indebted to the Right Hon.rble the Lord p.rprietarie in the Sume of tenn pounds Sterl to be Leveyd on his body goods and Chattles Lands and Tenements to the use of his Said Ld Ship his heires and Successors Conditionally that if he doe not make his appearance at next Court to be held in said County on the third tuesday in August next Ensueing to prosecute On his Ld Ships behalfe ag.st said Joseph Sanders and the Same Thomas acknowledges himselfe Content Ordered by the Court here that Sarah Hatchenson as an Evid.c in the Same cause give Surty for her ap.rc Thereupon Thomas Hatchenson afd her husband in his proper person comes into Court and acknowledges himselfe Indebted to the Right Hon.rble the Lord propry in the Sum of five pounds Sterl to be Leveyed on his body goods and Chattles Lands and Tenements to the use of his Said Lord Ship his heires and Successors Conditionally that if the Same Sarah Hatchenson his wife Shall not ap.r at the next Court to be held for Said County on the third tuesday in Aug.t next ensueing to give her Evid.c on his Said Lord Ships behalfe his s.d cause ag.st the afd Joseph Sanders wherewith he acknowledges himselfe Content Ordered by the Court here that John Macdaniel of Same County plant.r ent.r into Recog.c as Evid.c in y.e Same Court for his app.rc to next Court Thereupon the Same John Macdaniel comes into Court and in his prop.r pson acknowledged himselfe Indebted to the Right Hon.rble the L.d propry in the Sum of two pounds Sterl to be Leveyed on his body goods and Chattles Lands and Tenements Ship his heires and Successors Conditionally that if he do not ap.r at next Court to be held for Said County on the third tuesday in August next ensueing to give his Evid.c on his Said Lord Ships behalfe his said cause ag.st the afd Joseph Sanders wherewith the Said John Macdaniel acknowledges himselfe Content Ordered by the Court here that Thomas Hynson jun.r comes into Court and in his proper pson acknowledged himselfe Indebted to the Right Hon.rble the Lord propry in the Sum of five pounds Sterl to be Leveyed on his body goods and Chattles Lands and Tenements to the use of his Said Lord Ship his heires and Successors Conditionally that if he do not appear at y.e next Court to be held for Said County on the third tuesday in August then next ensuing to give his Evid.c on his Said Lord Ships behalfe against the afd Joseph Sanders wherewith the Said Thomas Hynson Acknowledges himselfe Content Tho Hatchenson at last Court ent.rd into Recogniz.c for his ap.rc to this Court as an Evid.c ag.st y.e Same The afd Tho ap.rs Ordered by y.e Court that the Same be disch.d Thomas Hatchenson at last Court entered into Recognizance in the Sum of tenn pounds Sterl &c.a for the ap.rc to this Court as an Evid.c for his Lordship ag.st the afd Joseph Sanders the Court here discharges the Same |
