135 here the Said Recognizance and his Suretys be discharged &c.a The afd William Copper Recognizance at last Court being taken in the Sum of five pounds Sterl to be Leveyd &c.a and to answ.r as afd and in the mean time he was to be of good behav.r No pson Shewing any cause to the Contrary the Same Recogniz.c are by this Court here disch.d As also George Coppers Recog.c in the Same Sum for the afd W.m is by this Court here disch.d
of Tobacco of the goods and Chattles of a Certain William Clarkes then and there being found then and there feloniously did steal take and bear away contrary to the peace of the Said Lord proprietarie that now is his good rule and Government and against the form of the Act of Assembly in Such Case lately made and provided Test John Hasely Rachel Clarke T ffrancis Cler. pacis On the back of y.e Same Indictm.t was endorst as foll. viz.t Billa Vera pine Tho.s Hynson foreman And the afd Patrick Carwack in his proper pson comes and Saith that he is in no Sort guilty of the premisses above upon him Imposed as by the afd Indictment it is alledged & thereof he putteth himselfe upon the Country Pat Carwack in pp.r pson And he who followeth for the Lord propry in like manner Saith he is guilty T ffrancis p Ld propry Whereupon Command was given to the Sherf of Kent County that he Immediately cause to come here twelve &c.a whom &c.a who neither &c.a To Recognize &c.a because as well &c.a Off which Said pcept the Said Sherf to wit Joseph Young Gent now here at this day to wit the Sixteenth day of June Anno Dom. Seventeen hundred and thirty makes Return that he hath here Ready twelve as by his precept he was Commanded and come here afterwards to wit the day & year last mentioned came against the afd Ld propry by Tench Francis afd and the afd put in his proper person and the Jurors of that Jury being Impannelled and Called likeways came to wit James Thomas Charles Smith Jn.o Cooper William Deane Jeremiah Covington James Ringgold jun.r Nich.o Reyley Geo Skill John Tucker Henry Trulock Thomas Hatchenson Tho.s Husbands who being duely elected tryd & Sworn to say the truth in the premisses upon their Oath do Say Patrick Carwack is guilty of the felony of Stealing the above Shirt as he Stands Indicted and by James Thomas there foreman all So Say Therefore it is Considered by the Justices here to wit at the Court House in the Town of Chest.r in Said County on the third tuesday in June Anno Dom. Seventeen hundred and thirty That the afd Patrick Carwack Stand in the pillory for the Space of one quarter of an house and afterwards he to Receive at the publick whipping post Eight Lashes ^well laid out^ on his bare back tell the blood appear as a punishment for the afd Crime of felony according to the force form and effect of the Verdict afd and also pay the Sume of Eighty pounds of Tobacco it being for the four fold of the goods So as afd Stoln and also pay the Sume of Seven hundred Eighty Nine pounds of Tobacco Cost Accrueing on the premises afd to the form of this Court It is also Considered by the Court here to wit the Same day and Year last mentiond That |
