March Court 1729 Copper the tenth day of February Anno Dom. Seventeen hundred twenty and Nine at the Parish afd in the County afd within the Jurisdicon of this Court with force and Arms one Horse of a bay Colour of the price of Nine hundred pounds of Tobacco of the goods & Chattles of a Certain George Copper then and there being found then and there feloniously did Steal take and lead away Contrary to the peace of the Said Lord p.rytarie that now is his good Rule and Government and against the form of the Act of Assembly in Such case lately made and provided Testes W.m Copper T ffrancis On the back of the preceeding Indictm.t was endorsed as foll viz.t A true bill p Gid.n Pearce foreman And the afd Emanuel Drew in his proper person cometh and Saith that he is in no Sort guilty of the premises above upon him Imposed as by the afd Indictm.t it is alledged And thereof he putteth himselfe upon the Country Emanuel Drew in p.r pson And he who followeth for the Lord prop.ry in like manner Saith he is guilty T ffrancis p L.d p.rp.ry Thereupon Command was given to the Sherf of Kent County that he Immediately cause to come here twelve &c.a by whome &c.a who Neither &c.a To Recognize &c.a because as well &c.a of which Said precept the Said Sherf to wit Joseph Young Gent now here at this day to wit At the Court House in the Town of Chester in Said County on the third tuesday in March being the Seventeenth day of Said Month Anno Dom. Seventeen hundred and twenty Nine Makes return that he hath here ready twelve &c.a as by his precept he was Commanded And now here afterwards to wit the day and Year last mentioned Come againe the afd Lord prop.ry by his Attry afd and the afd Emanuel Drew in his proper person And the Jurors of that Jury being Impannelled and Called likewise came to wit Thomas Wilkins Samuel Andrews John Ashley William Deane John Walls Christopher Bellican Thomas Hatcheson Matthias Day Thomas Marsey Joseph Tralock John Macdougall & Nicholas Maray who being Elected Tryd and Sworn to Say the truth in the premises upon their Oath do Say Emanuel Drew is guilty of Stealing the afd Horse as he Stands Indicted And by Thomas Wilkins there foreman al So Say Therefore it is Considered by the Justices here to wit the Same day and Year last mentioned That the afd Emanuel Drew Stand in the pillory for the Space of one quart.r of an hour and afterwards Receive at the publick whipping post on his bare back five Lashes tell the blood appear as a punishment for his afd Crime of felony According to the effect force & form of the Verdict afd Also it is Considered that the Said Emanuel Drew pay the Sume of four pounds Current money it being that part the Court adjudges you to pay of the four fold of the afd Goods So Stoln being half and also the Sume of Six hundred twenty one pounds of Tobacco Cost accrueing on the premises afd to the officers of this Court It is also Considered by this Court here to wit the Same day and year last mentioned that the Sherf of Kent County take the afd Emanuel Drew into his Custody and Execute the punishment in the Judgment afd Specified and afterwards to bring him into Court of which pcept the Said Sher to wit Joseph Young Gent high Sherf of Kent County makes Return on the day and year last ^said^ that he hath Executed the Said Judgment as |
