crete road on said Baltimore Avenue as in the first section here-
of set out and for no other purpose whatever; if the said Mayor
and City Council shall see fit said bonds or such amount thereof
as may be necessary, not exceeding the sum of twenty-five thou-
sand dollars in the aggregate, may be used in the payment of
the cost of the construction of said road at a valuation of said
bonds of not less than par and such of said bonds as may be
used in such payment need not be actually turned into cash and
the money deposited as hereinbefore set out, but an accurate
account of such use of said bonds in payment for said road shall
be kept in the records of the said town.
SEC. 6. And be it further enacted as aforesaid, That nothing
herein contained shall be construed to nullify, limit, change or
abridge the right on the part of the Mayor and City Council
aforesaid to assess the whole or any part of the cost of said road
to the abutting owners under the provisions of any Act or Acts
heretofore passed; and all funds that may be realized from the
assessment of such cost or any part thereof against the abutting
properties shall be kept by the said Mayor and City Council
as a separate fund and shall be used only in the payment of
the cost of said road as to such funds as may be realized from
said assessments before the issue of said bonds, and to the re-
tirement of said bonds as to such funds as may be realized from
said assessments after the issue of said bonds; and with the con-
sent of the holders of said bonds the said Mayor and City
Council may retire any of said bonds before the maturity
thereof whenever such special fund is sufficient for such retire-
ment of any of said bonds.
SEC. 7. And be it further enacted as aforesaid, That the
Treasurer of said town of Ocean City shall keep in a book for
the purpose a full registry of the bonds sold, the different se-
ries, the number of the bonds and the name of the purchaser
and the amounts realized from the sale and any transfer and
assignments of the same when requested by any subsequent pur-
chaser or purchasers.
SEC. 8. And be it further enacted as aforesaid, That the
said Mayor and City Council shall deposit in some National
Bank in Worcester County the money necessary for the pay-
ment of the principal and interest on said bonds after the same
may mature and become due and shall designate said bank on
said bonds and the coupons thereto attached.
