the Fire Department of the City of Cumberland on the basis
of a two-platoon system, with the hours of duty of each of said
platoons to be prescribed by the Mayor and City Council, who
shall have the power to prescribe the rules mid regulations for
the shifting of said platoons.

39. The Health Officer, Solicitor. Engineer, Auditor and
Chiefs of the Police and Fire Departments shall attend all
regular meetings of the Mayor and City Council, and any
special meetings of said Mayor and City Council at which their
presence may be requested by any member of the City Council.
They shall have the privilege of participating in the discussion
of matters relating to their respective departments, but shall
have no vote.

40. All official bonds required under this Act, except the
bonds of the members of the Mayor and City Council, shall be
made payable to the Mayor and City Council of Cumberland,
and shall be in such form and with such sureties as the Mayor
and City Council may prescribe.

41. All bonds executed to the said Mayor and City Coun-
cil of Cumberland for the faithful discharge of the duties of
the several officers required by law or ordinance to give bond
shall be recorded in the office of the Clerk of the Circuit Court
for Allegany County, and a certified copy thereof under seal
shall be evidence to prove the execution of such bond in any
of the courts in this State.

42. The Mayor and City Council shall have authority
from time to time to create and fill and discontinue all offices
and employments other than herein prescribed, according to
their judgment of the needs and requirements of the city, and
in their discretion, by a majority vote of all the members of
the City Council, to remove for or without cause the incumbent
of any such office or employment, and may, and by order or
otherwise, prescribe, limit or change the compensation of such
officers or employees.

43. In case of sickness, or absence, or inability from any
cause on the part of any official to perform his duties, the
Mayor and City Council may provide for the performance of
such duties by a temporary substitute for such officer, or other-
wise, as they may deem best, and the acts performed by such
substitutes or otherwise, as the said Mayor and City Council
may direct, shall be deemed as valid for all intents and pur-
poses as though performed by the said official himself.
