ed state, and have prayed that a law may pass authorising a lottery to raise a sum of money for
the purpose of finishing said church ;

CHAP.

XXXV.

II. BE IT ENACTED, by the General Assembly of Maryland^ That It shall and may be lawful for Ja-
cob Wolfe. Charles Baltzell, senior, John Baltzell, Bernard Gilbert, John Shank, George Keller
and Charles Clance, or a majority of them, to propose a scheme or schemes of a lottery for raising
a sum of money, not exceeding two thousand dollars, and to sell and dispose of the tickets thereof;
provided the said Jacob Wolfe, Charles Baltzell, senior, John Baltzell, Bernard Gilbert, John Shank,
George Keller and Charles Clance, or a majority of them, as shall undertake to act under this law,
shall, before the sale or disposal of any ticket or tickets in said lottery, give their bond to the state
of Maryland, in the penalty of four thousand dollars, conditioned that they will well and truly apply
so much of the money arising therefrom, within six months after the drawing of said lottery shall
commence, as will satisfy the fortunate adventurers for prizes drawn by them, and after deducting
the necessary expences incurred in said lottery, shall, within one year from the time of drawing
of said lottery shall commence, cause the said church to be finished in the best manner the sum of
money raised by said lottery will admit.

III. AND BE IT ENACTED, That it shall be the duty of said commissioners, before they act as
such, to lodge such bond in the cterk's office of Frederick county, there to be recorded, and upon
such bond, or office copy thereof, suit or suits may be instituted against the obligors therein, or
any of them, or their legal representatives, for any breach or non-compliance with the condition of
the same.

An ACT to repeal an act, entitled, An act to restrain the ill prac-
tices used by sheriffs in taking goods by fieri facias, and selling
them by venditioni exponas.

BE IT ENACTED, by the General Assembly of Maryland, That the act, entitled, An act to restrain
the ill practices used by sheriffs in taking goods by fieri facias, and selling them by venditioni ex-
ponas, passed at a session of assembly, begun and held at the city of Annapolis on the seventeenth
day of July, and ended the tenth day of August, in the year of our Lord seventeen hundred and
sixteen, shall be and the same is hereby repealed, abrogated and made void.

CHAP. XXXVII.

An aft repeal-
ed.

A Supplement to an act, entitled, An a6t authorising the trustees of
Charlotte-Hall school to lay off a town in Saint-Mary's county by
the name of Charlotte-Ville, and to dispose of the lots therein
by lottery.

Passed 31st of
Dec. 1803.

WHEREAS, by the act to which this is a supplement, there is no power given to the trustees
to appropriate any part of the money arising from the sale of tickets in the scheme or schemes
of a lottery to be by them proposed to the purpose of cash prizes, or in any other manner to create
the same, for the want of which, it is represented to this general assembly, by the said trustees,
they have been prevented from carrying such scheme or schemes into effect; therefore,

Preamble,

II. BE IT ENACTED, by the General Assembly of Maryland, That it shall and may be lawful for the
said trustees, or any five of them, to apply such part of the money arising from the sale of the tick-
ets ia the scheme or schemes of a lottery to be by them proposed tothe purpose of cash prizes, or
to create the same in any other manner that they may think best to further or promote such lottery ;
provided, that any five or more of the said trustees shall, before the sale or disposal of any ticket
or tickets in any such scheme or schemes of a lottery, give their bond in the manner prescribed in
the act to which this is a supplement, and in the same penalty, for the payment of the said cash
prizes to the fortunate adventurers within twelve months from the drawing the said lottery, which
bond shall be lodged in the cterk's office of Saint-Mary's county, and recorded in the same manner,
and for such like purposes, as are prescribed with respect to the bond by them to be given in the said
original aft.
