XCVI.

to inquire into the circumstances of the aforesaid sale, and if it shall appear to them that the
aforesaid. Edward Willet was the real purchaser of the aforesaid land, and that the aforesaid James
A. Magruder was only the ostensible purchaser of the same, that then and in that case the afore-
said court shall direct the aforesaid commission to be returned to the commissioners therein named,
or the survivors of them, and the said surviving commissioners, or the majority of them, shall.
alter and amend their return on the said commission, by substituting the name of the said Edward
Willet for that of the aforesaid James A... Magruder.

III. AND BE IT ENACTED, That upon the correction of the return of the aforesaid commissi-

Ground may
be condemned,
&c.

An ACT respecting Ten Feet lane, in the city of Baltimore,

BE IT ENACTED, by the General Assembly of Maryland, That the city commissioners of the city
of Baltimore be and they are hereby authorised to condemn, as a public street of the said,
city, all the vacant ground in the lane called Ten Feet Lane, in the said city, between the build-
ings on the east and weat side of the said lane, provided that the entire width of the said street,
from the east side thereof shall not, exceed sixteen and a half feet, and to record the, said street,
as in other cases, by the name of M'Clelian's-Street...

CHAP. XCVIII.

An ACT respecting the register of wills for Calvert county,

*\7C7 HERE AS-"- it is represented that there is no necessity for the register of wills for CalverC
V V county to attend at the place where the orphans court is held except on those days appoint-
ed for the meeting of said court, his office being fixed at a more central and convenient spot, for
the accommodation of the people of the county, and not more than four miles distant from the
court-house ;.. therefore,

Justices to take
into considera-
tion, &c.

I.I. BE IT ENACTED, by the General Assembly of Maryland, That it shall and may be lawful for
the justices of the orphans court for said county to ; take into consideration the necessity and ex-
pediency of the register of wills of said county being obligecUto attend at the place where the said
court is held, except on days upon which the said orphans court shall be appointed to be held, and
in case they shall be of opinion that the convenience of the people of the county doth not require
the attendance, of the register at the place aforesaid,,, they shall cause an, en-try to be made in their
proceedings to that effeii.

No prosecution
to be com-
menced, , &c

III. AND BE IT ENACTED, That after the determination of the court aforesaid against the ne-
cessity of the register's attending at the place aforesaid, except as is before excepted, no prosecu-
tion shall be commenced or carried on against the register for his non-attendance at, the place
aforesaid, any thing in any act of assembly to the contrary notwithstanding, and in case of any
such prosecution the said register may give this act in evidence ; provided nevertheless, that
nothing herein contained shall prevent the register from being compelled to attend as a witness,
when, summoned.,

An ACT to augment the shares of the Susquehanna canal com-
pany

Number of
shares may be
enlarged, &c.

BE IT ENACTED, by the General Assembly of Maryland That it shall and may be lawful for the
proprietors of the Susquehanna canal to enlarge their number of shares at a meeting of the
company, by adding thereto a number not exceeding ten shares, and all subscribers to such ten
shares shall and are hereby from thenceforth declared to be incorporated into said company, and
to.be entitled to all the rights, benefits and privileges, of original subscribers to the said canal.
