99 (50) Kent fs August y.e 26.th 1685 The same Courtt sitts Againe as yesterday This Courtt haveing Attended to sitt According to y.e Adjornm.t yesterday & neither y.e sheriff nor his Deputy appearing have fined y.e s.d sheriff one hundred pounds of tobacco Robert Clarkes agst George Green George Green of the County standeth Attacht to Answer Unto Robertt Clarke in A plea of trespass on y.e Case And Whereupon y.e s.d Robertt Clarke by William Harris his Attorny Complaineth & saith: that y.e s.d George standeth Indebted unto him y.e s.d Robertt in y.e sum of one Barrill of Indian Corne as by his Ac.tt herein Courtt produced will more at Large appear yett y.e s.d George to him y.e s.d Robertt y.e s.d sum of one Barrill of Indian Corne: hath not payed & satisfied: but y.e same to paid hath refused & yett Doth refuse: to y.e Damage of y.e s.d Robertt y.e sum of two hundred pounds of tobacco Harris p.a q.r James Lisson agst Christ Roberts Christopher Roberts of this County standeth attached To Answer James Lisson Carpent.r in A plea of trespass on y.e Case And whereupon y.e s.d James by William harris his Attorny Complaineth & saith That y.e Christopher standeth indebted unto him y.e s.d James in y.e sum of sixty six pounds of tobacco as by his acc.tt herein Courtt Produced will more at Large appeare yett y.e s.d Christo y.e sum afores.d to him y.e s.d James hath not paid Although often thereunto Required but the same to pay hath Denied & still doth Deme to y.e Damage of y.e s.d James: the sum of one hundred pounds of tobacco & thereupon he brings his suite Christ.r Robert is &c Harris
James Lisson pltt a plea And y.e s.d Christ.r by Robertt smith his Attorny Comes & Defends y.e force & Injury when & saith y.t y.e plt his action Against him ought not to have & maintain for y.e many Insuficies in y.e plts Declaration first in y.e body of s.d Declaration there is no date to y.e accomp.t now place where the Debt was Contracted nor when to be p.d & therefore uncertaine: & all declarations ought to be plaine & Certaine secondly in y.e same Declaration no Asumption is paid & therefore no debt: for w.ch Insuficiencies & uncertainties we are not bound to ans.r And of this we pray Judgment of this Courtt &c smith |
