Answer Unto Thomas Bruff of Talbott County a plea of [illegible]
open y.e Case

And hereupon y.e s.d Thomas Test by Robertt Smith his Attorny
Complaineth & saith That y.e s.d Edward Rogers in his Life time
stood Justly Indebted unto y.e s.d Thomas in y.e Just sum of seven
hundred & twenty pounds of tobacco A perticuler whereof is here in
Courtt produced & Already proved as may appeare Notwithstanding
y.e s.d Edward Rogers in his Life in his time Did not [illegible] y.t
y.e s.d Thomas the Afores.d sum of seven hundred & twenty
pounds of tobacco: nor y.e s.d Edward sweatnam in his [illegible]
since his Death: hath not Paied the same nor any partt nor
parcell thereof but y.e same to pay hath hetherto Levyed &
still Doth Deny to y.e Damage of him y.e s.d Thomas one
Thousand pounds of tobacco & thereupon he bringeth his suit
                                                Smyth p q.r

The Issue Joyned the plt [illegible] paied by [illegible]
his oath & y.t he nor any person by his [illegible]
from Edward Rogers or any other [illegible] partt or parcel of
the s.d acc.t This Courtt haveing considered [illegible]
Doe Award Judgm.t for the said answer

Therefore it is Considered by this Court that y.e s.d Thomas
Bruff shall record from y.e Defend.t out of the [illegible]
of the s.d Edward Rogers the sum of seven hundred
& Twenty pounds of tobacco & Cost of sute
