And now here att this day the said cause standing for Tryal
came the said plt by Michael Earle his Att.ry as allsoe the Defd.t
by his said Attorney and the plt declares viz

Kent Co fs  Robert Davenish of sd County plant.r was Attached to Answer
unto Richard Wallis and Anna his Wife of a plea that Wherefore with force
and Armes an Assault upon the Body of her the said Anna he the said
Robert did make and her did beat wound and evilly Entreat soe that of
her life she did dispaire and other Enormities to her the said Anna
he the said Robert did doe contrary to y.e peace of our Soveraigne
Lord the King &c.a and to the great damage of the said Richard and Anna
his Wife &c.a

And whereupon the said plts by Michael Earle their Att.ry saith that
Whereas the said Robert Davenish the sixth day of Septemb.r Anno
Dom 1697 in Easterne neck Hundred within the Jurisdicon of this
Court with swords Axes staves clubs Knives and staves an Assault upon
the Body of her the said Anna did make and her the said Anna then
and there did beat wound and Evilly Entreat soe that of her life she
did dispaire and other Enormities to her the said Anna him the said
Robert did doe to the great damage of the said plts and contrary
to the peace of our Soveraigne Lord the King &c.a Whereupon the sd
plts say that they are damnified and have Received damage to
the value of Tenn Thowsand poundes of Tobaccoe and therupon
they being this Accon   Earle p q.r pledges &c.a John Doe Ri Roe

Oyer of the Writt Original   Macklin p Defd.t

Not guilty and of this he puts himselfe upon the Country    Macklin
 
And the plts saith he is guilty   Earle p qr

Command was therfore given to the sheerif of Kent County to cause
Twelve good and Lawfull men of his Bailiwick to come before
this Court to try the Issue Joyned as above w.ch jury are viz
