928 Command was given to the sheerif of Kent County that he cause Twelve good and Lawfull men of his Bailiwick to Try the Issue Joyned as before recited which jury are viz
Which jury being duely sworne to try the Issue Joyned as before recited and haveing heard the Evidence and pleadings on both sides the Court giveth them them their charge who withdraw to consider on the p.rmises and after some time doe returne and being called over as allsoe the plt and Defed.t doe say wee of the jury find for the Defend.t and soe they said all Judgm.t according to verdict of the jury Therfore it is considered by this Court that the Defend.t James Bruard doe recover from the Plt Phillip Wessels as well the sume of Fifty poundes of Tobaccoe for his false clamour as allsoe the sume of six hundred Forty and Two poundes of Tobaccoe cost of suit S Wilmer Clk Command was given to the sheerif of Kent County the 15.th day of February Anno Dom 1697 that he take Robert Davenish if he should be found in his Bailiwick and him safe Keepe soe that he stand his Body before his Maj.ties Justices att the next Court to Answer unto Richard Wallis of a plea of Trespasse upon the case Att which Court viz the 27.th day of Aprill Anno Dom 1698 the day of returne of said Writt came Cap.t Edward Sweatnam high sheerif of sd County and made returne of said Writt in these wordes viz Cepi Edw Sweatnam sheeft On which said day the said Robert Davenish by Richard Macklin his att.ry appeares and prayes therof to Imparle until the next Court w.ch was granted the same day is given to the plt likewise |
