Which jury being sworne to Try the Issue as before recited
and haveing heard the Evidences and pleadings on both sides
the Court giveth them their charge who withdraw to Consider on
the p.rmises and after some time doe returne and being called
over as allsoe the plt and defend.t doe say wee of the jury
doe find for the Defend.t and soe wee say all   Judgm.t upon
the verdict of the jury

Therfore it is considered by this Court that the Defend.t
Robert Davenish doe Recover from the Plt Richard Wallis
as well the sume of Fifty poundes of Tobaccoe for a non suit
as allsoe the sume of six hundred Ninety and six poundes of
Tobaccoe cost of suit

Command was given to the sheerif of Kent County the 18.th day
of Feb.ry Anno Dom 1697 that he take Richard Wallis if he should
be found in his Bailiwick and him safe Keepe soe that he have
his Body before his Maj.ties Justices att the next Court to Answer
unto Robert Davenish of a plea of Trespasse upon the case

Att which Court viz the 27.th day of April Anno Dom 1695 the day
by adjournm.t of returne of sd Writt came Cap.t Edward Sweatnam
high sheerif of said County and made returne of sd Writt in these
wordes   Cepi Edw Sweatnam sheft

On which said day the said Richard Wallis by Michael Earle his Att.ry
appeares and prayes therof to Imparle which was granted the same is
given to the plt allsoe

And now here att this day the said cause standing for Tryal came
the said plt by Richard Macklin his Attorney and likewise the Defd.t
by Michael Earle his said Att.ry and the plt declares viz

Kent fs  Richard Wallis of sd County Cooper stands Attached to Answer
unto Robert Davenish of a plea of Trespasse upon the Case
And Whereupon the said Robert by Richard Macklin his Att.ry Complains
that Wheras the said Richard Wallis formerly to Witt att a
Court held the 25.th day of August Anno Dom 1697 before
