927 Command was Given to the sheerif of Kent County y.e 26.th day of November Anno Dom 1697 that he Take James Bruard if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the next Court to answer unto Phillip Wessels of a plea of Trespasse upon the case Att which Court viz the 15.th day of February the day by adjournment of returne of said Writt came Cap.t Edward Sweatnam high sheerif of said County and made returne of sd Writt in these wordes Cepi Edw Sweatnam sheft On which said day the said James Bruard by Michael Earle his Attorney appeares and prayes therof to Imparle until the next Court which was granted the same day is given to plt likewise Which said cause being continued from Court to Court until this present day and now standing for Tryal came the said Phillip Wessels by Richard Macklin his as allsoe the said James Bruard by Michael Earle his said Attorney and the plt declares viz Kent fs James Bruard of said County stands Attached to Answer unto Phillip Wessels of a plea of Trespasse &c.a And whereupon the said Phillip by Richard Macklin his Attorney complains that Whereas the said James on the 2.d day of Jan.ry Anno Dom 1697 in said County within the Jurisdicon of this Court by force and Armes on him the said Phillip an Assault did make & him the said Phillip beat then and there beat wounded and evil handled soe y.t of his life he did dispaire and allsoe soe grievious wound upon the head of the said Phillip then and there put on him soe that the same Phillip by reason of the extraordinary effusion of blood out of y.e same wound flowing and ariseing fell into great sicknesse and weaknesse of his Body then and there and stood in great danger of loosing his life and divers difficult businesse of him the said Phillip by reason of the aforesaid Likewise and Weaknesse were delayed and undon and other harmes &c.a ag.t the peace &c.a to the damage of the said Philip six Thowsand poundes of Tobaccoe and therupon he brings this suit Macklin p q.r pledges &c.a John Doe Rich Roe
And the sd Phillip by his said Att.ry saith he is Guilty Macklin |
