Plea And the said Defend.t by Michael Earle
his Attorney comes and defends the Force and
Injury when &c.a and for plea saith that the aforesd plt
his Action ag.t him the sd Defend.t he ought not to have and
maintaine by force and vertue of the said Judgm.t obtained
in Cæcil County Court for that the sd Defend.t by protestation
saith that he paid and delivered unto the said plt Thirteene
pair of Iron fetters which amounts to the sume of One Thowsand
Three hundred poundes of Tobaccoe as by an Accompt
here in Court brought may appeare all this he the sd Defend.t
is ready to Aver and prove and prayes Judgm.t &c.a Earle p Defd.t

And the said Plt by his said Attorney for
Replication saith that the said Defend.t hath
not paid Thirteene pair of Fetters in part of the said plts accon
and of this he puts himselfe upon the Country   Macklin p q.r
                            And the Defend.t in like manner   Earle p Defd.t

Command was therfore given to the sheerif of Kent County to
cause Twelve good and Lawfull men of his Bailiwick to come
before this Court to Try the Issue Joyned as above which jury are
viz

John Pender
Thomas Scotton
William Robinson
William Sparkes Jun.r
John Hues
Georg Smith
John Tillard
John Mosse
Thomas Punney
William Boulton
Thomas Smith
Henry Green

Jurors

Which jury being duely sworne the Try the Issue as before recited
and haveing heard the Matter in Evidence and pleadings on both
sides the Court giveth them their Charge who withdraw to consider
on the p.rmises and after some time doe returne who being called
ever as allsoe the plt and defend.t doe say that they find for the
plt and soe they say all Judgm.t Awarded on the verdict

Therfore it is considered by this Court that the plt Jacob Gibson
doe recover from the Defend.t William Evans all well the aforesaid
Eleaven pair of Iron spancels with the two Hundred Eighty and Nine
poundes of Tobaccoe according to the Judgm.t obtained ^in^ Cæcil Court as allsoe
the sume of six hundred Seaventy and Five poundes of Tobaccoe
cost of suit
