sheerif of sd County and made returne of sd Writt in these
words viz   Cepi Edw Sweatnam sheft

On which day the said Defend.t by Michael Earle his
Attorney appeares and prayes therof to Imparle until y.e
next Court which was granted the same day is given to the
plt allsoe

Which said cause being continued from Court to Court
until this p.rsent day and now standing for Tryal came the
sd Plt by Richard Macklin his Att.ry and the said Defend.t
by his sd Attorney and the plt declareth viz

Kent fs  William Evans otherwise called William Evans late of
Cæcil County Blacksmith was summoned to Answer unto Jacob Gibson
of a plea that he render him Eleaven pair of Iron Spansels and
Two hundred Eighty and Nine poundes of Tobaccoe which to him
he oweth and from him he unjustly deteineth

And whereupon the said Jacob by Richard Macklin his Attorney
complains that Whereas att a Court held for Cæcil County the 23.d
day of Feb.ry in the Ninth Yeare of his Maj.ties Reigne Annoq Dom
1697 by William Harris and the rest of his Associates his Maj.ties Justices
of sd County Court within the Jurisdicon of this Court the sd
Jacob att the time and place aforesd recovered ag.t the sd William
Evans as well the said Eleven pair of Iron Spancels his debt as allsoe
the sume of Two hundred Eighty and Nine poundes of Tobaccoe
cost of suit Expended and laid out in said Cæcil Court by reason of
the said Williams detainder of the said Iron spancels as by the
Records of the said Cæcil County Court the same appeareth a
Transcript of which said Record is here in Court brought Yett
Notwithstanding the said William Evans the said Debt and cost
unto the sd Jacob he hath not paid but the same to pay hath denied
and still doth deny and unjustly deteine to the damage of the sd
Jacob Gibson besides the sd Debt and cost 1000.ll of Tobaccoe and
therupon he bringeth this suit Macklin p q.r pledges &c.a John Doe
