Therfore it is considered by this Court that the Defd.t
Robert Norrest doe Recover from the plt Christopher
Denny as well the sume of Fifty poundes of Tobaccoe
for a Non suit as allsoe the sume of Eight Hundred Fifty
and six poundes of Tobaccoe cost of suit

Command was given to the sheerif of Kent County the 26.th
day of November Anno Dom 1697 to take William Evans if
he should be found in his Bailiwick and him safe Keepe
soe that he have his Body before his Maj.ties Justices att the
next Court to Answer unto Jacob Gibson of a plea that he
render unto him 1139.ll of Tobaccoe

Att which Court viz the 15.th day of Feb.ry Anno 1697 the
day by adjournm.t for returne of sd Writt came Cap.t Edward
Sweatnam high sheerif of sd County and made returne of sd
Writt in these words viz   Cepi Edw Sweatnam sheft

On which said day the said William Evans by Michael Earle
his Attorney Appeares and prayes therof to Imparle until the
next Court which was granted the same day is given to the
plt allsoe

Which said cause being continued from Court Court until
this p.rsent day and now standing for Tryal came as well the
said Plt by Richard Macklin his Attorney as allsoe the Defend.t
by his said Attorney and the plt declares viz

Kent fs  William Evans als dict William Evans late of Cæcil County
Blacksmith that he render unto him the sume of Eleaven hundred
Thirty and Nine poundes of Tobaccoe which to him he Oweth and
from him he unjustly deteineth

And whereupon the sd Jacob by Richard Macklin his Attorney complaines
that whereas att a Court held for Cæcil County the 23.d day
of Feb.ry in the Ninth Yeare of his Maj.ties Reigne Annoq Dom 1697
