918 Command was therfore given to the sheerif of Kent County he cause Twelve good and Lawfull men of his Bailiwick to come before the Court to Try the Issue Joyned as aforesd w.ch Jury are viz
Which jury being sworne to try the Issue as aforesd and haveing heard the Evidence as allsoe the pleadings on both sides the Court giveth them their charge who withdraw to consider on the p.rmises and after some time doe returne and being called over as allsoe the said Richard Macklin who &c.a and the Defd.t Edward Fry the said jury doe say they find for the Defend.t and soe they say all Therfore it is considered by this Court that the said Edward Fry be discharged from the said Informacon and goe from hence without day S Wilmer Clk William the Third by the Grace of God of England Scotland France and Ireland King Defender of the Faith To our Justices of our County of Kent Greeting Whereas Charles Webb of Your County Mariner did pray us for our Writt of Habeas Corpus cum causa to be to You directed for the removal of a certain cause then and there depending before You Betweene John Hawkins plt and the sd Charles Webb defd.t in a plea of Trespasse upon the case w.th all proceedings before You relateing therto together w.th his Body then said to be Imprisoned for the same Before our Justices att our then next Provintial Court which was Held att our Port of Annapolis the 6.th day of April Instant w.ch said Writt was granted to him dated the 26.th day of October in the Ninth Yeare of our Reigne and under our lesser seale of our Province of Maryland Annoq Dom 1697 wherby the sd Record and proceedings were Transmitted before our sd Justices on the day and att the place aforesd and the said Charles Webb discharged from |
