The Province of Maryland y.e Eighth day of May Ann.o Dom 1695
att the Port of Annapolis Entituled an Act for regulateing Ordinaries
and limiting the Number of them within this Province it
stands Enacted by the Authority of the same Assembly that
any Ordinary Keeper disabled or surprest or any other person
that shall presume to Keepe Ordinary without Lycence first
had and obtained Except all such persons as sett up or Keepe
Ordinary or Ordinaries att the Port of Annapolis within the
County of Ann Arundel shall for every Month he or they shall
Keepe Ordinary as aforesd forfeit and pay the sume of Tenn
Thowsand poundes of Tobaccoe one halfe to their Maj.ties and the
other halfe to him or them that shall sue for the same to be
recovered in any Court of Record within this Province by Bill
plaint or informacon wherein no Essoine protection or Wager
of Law to be allowed Yett Neverthelesse the aforesd Edward little regarding
the aforesd Act of Assembly nor in any manner fearing
the penalty in the said Act contained after the publishing the said
Act and before the day of exhibiting this informacon that is to
say att Chester River within the Jurisdicon of this Court the
first day of October Anno 1697 and continually after for the
space of one whole month then next ensueing hath presumptuousley
Kept an Ordinary without Lycence first had and obtained
ag.t the forme of the said Stature in that case made and provided
by which the said Edward hath forfeited and lost Tenn Thowsand
poundes of Tobaccoe whereupon the sd Richard who followes as
well for our Soveraigne Lord the King as for himselfe prayes the
advisem.t of the Court in the p.rmises and that he the said Richard
may have the Moiety of the forfeiture according to the forme and
effect of the same Act of Assembly as allsoe that the aforesd Edward
may come here into Court and Answer in and upon the p.rmises
