889 And now here att this day came the sd Plt by Richard Macklin his Att.ry as allsoe the sd Defend.t by his sd Att.ry & the said cause standing for Tryal y.e Plt declareth viz Kent fs George Foxon of sd County Carpenter stands Attached to Answer to Sam.l Tovey of a plea of Trespasse upon the case &c.a And Wherupon the sd Samuel Tovey by Richard Macklin his Attorney complains and saith that wheras the sd George Foxon in August 1697 in sd County within the Jurisdicon of this Court stood justly indebted to y.e sd Sam.l Tovey in the full and just sume of One pound Three shillings and six pound sterl p Acc.o the perticulers therof and here in Court brought In consideracon therof the sd George Foxon upon himselfe assumed and to the sd Sam.l Tovey he Faith fully promised that he the said George Foxon the sd sume of 1.ll 3.s 6.d sterl when therunto required would well and truely pay Yett Neverthelesse the sd George Foxon the said sume of 1.ll 3.s 6.d sterl according to his promise and Assumption aforsd unto the sd Samuel he hath not paid alltho often required but the same to pay he hath denied and refused to the damage of the sd Samuel Two poundes Seaven shillings and therupon he brings this suit Macklin p q.r pledges &c.a John Doe Ri Roe To which the sd Defend.ts Attorney pleades Non sum Informatus Earle p Defend.t Wherupon the sd plt by his sd Attorney moves this Court for Judgment which is Accordingly granted Therfore it is considered by this Court that the plt Samuel Tovey doe recover from the Defd.t as well the aforesd sume of One pound Three shillings and six pence sterl as allsoe y.e sume of Two hundred and Nineteen poundes of Tobaccoe cost of suit S Wilmer Clk
