stood justly indebted unto the sd Robert in the full and just
sume of Five hundred poundes of Tobaccoe it being for
One set of plow Irons In consideracon wherof the sd Jn.o
upon himselfe Assumed and tot he sd Robert he faithfully
promised that he the sd John the sd sume of 500.ll unto y.e
sd Robert would well and truely pay when thereunto required
Yett Neverthelesse the said John the sd sume of 500.ll of
Tobaccoe according to his promise and Assumption aforsd
unto the sd Robert he hath not paid alltho often therunto
required but the same to pay he hath denied and refused
and still doth deny and refuse to the damage of the sd Rob.t
1000.ll of Tobaccoe therupon he brings this suit
                       Macklin p q.r pledges &c.a Jn.o Doe Ri Roe

To which the sd Defend.t comes into Court and confesseth
Judgm.t

Therfore it is considered by this Court that the plt Robert
Norrest doe Recover ^from John Nayland^ as well the aforesd sume of Five hundred
poundes of Tobaccoe as allsoe the sume of Two hundred
and Fifteen poundes of Tobaccoe cost of suit

Command was given to the sheerif of Kent County the 25.th
day of Jan.ry Anno Dom 1697 that he take George Foxon if he
should be found in his Bailiwick and him safe Keepe soe y.t
he have his Body before his Maj.ties Justices att the next Court
to Answer unto Samuel Tovey of a plea of Trespasse upon y.e
case

Att which sd Court viz the 15.th day of February Anno Dom 1697
the day of returne of sd Writt came the Cap.t Edward Sweatnam
high sherrif of sd County and made returne of sd Writt in these
words viz   Cepi Edw Sweatnam sheft

On which sd day came the sd Defend.t by Michael Earle his
attry and appears and prayes therof to Imparle until y.e
next Court which was granted the same day is given to the p.lt
likewise
                                                                               And
