886 Kent fs James Williams otherwise called James Williams late of Talbot County Planter was summoned to Answ.r to Thomas Bruff of a plea that he render ^unto^ him one gray mare which to him he Oweth and from him he unjustly detains And Whereupon the sd Thomas by Michael Earle his Att.ry saith that Wheras the sd James To Witt y.e 14.th day of April Anno Dom 1690 in sd County within the Jurisdicon of this Court by his certain Writing obligatory sealed with his seale as his Act and deed delivered and here in Court himselfe to pay and deliver to the sd Thomas Bruff or his order one Gray Maire as aforesd sound wind and limb upon the Plantacon of M.r Thomas Herman on Chester River upon demand after the date of the same Wrighting Yett Notwithstanding the sd James the aforesd Gray Maire according to the Ten.r of the same Writing unto the sd Thomas or his order he hath not paid and delivered alltho often therunto required but y.e same to pay and dd he hath denied & refused and still doth deny and refuse and unjustly deteine to the damage of the sd Thomas 2000.ll of Tobaccoe and therupon he brings this suit Earle p q.r pleadges Nil debet p patriam To which the sd Plt Neither by himselfe nor Attorney would Joyne Issue Wherupon the sd Defend.t by his sd Attorney moves this Court for a Non suit which is Accordingly granted Therfore it is considered by this Court that the Defend.t James Williams doe recover from the plt Thomas Bruff as well the sume of Fifty poundes of Tobaccoe for a Non suit as allsoe the sume of One hundred Eighty and three poundes of Tobaccoe cost of suit S Wilmer Clk |
