885 Which Jury being duely sworne to Try the sd Issue and haveing heard the pleadings on both sides the Court giveth them their charge who withdraw and after some time doe againe returne and bring called over according to the recited Pannel as allsoe the plt and defend.ts doe say they find for the Defend.t Wherupon the sd Defend.t by his said Attorney moves this Court for a Non suit which is Accordingly granted Therfore it is considered by this Court that the Defend.t James Williams doe Recover from the plt Thomas Bruff as well the sume of Fifty poundes of Tobaccoe for a Non suit as allsoe the sume of six hundred and Fourteen poundes of Tobaccoe cost of suit S Wilmer Clk Command was given to the sheerif of Kent County the 23.th day of June Anno Dom 1697 that he take James Williams if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the next Court to Answer unto Thomas Bruff of a plea that he deliver One gray Mare Att which Court viz the 24.th day of August Anno Dom 1697 the day of returne of sd Writt came Cap.t Edward Sweatnam high sheerif of sd County and made returne of sd wri writt in these wordes Cepi p me Edw Sweatnam sheft On which said day came the sd Defend.t by Richard Macklin his Attorney and Appeares and prayes therof to Imparle until the next Court which was granted the same day is given to the plt likewise Which said cause being continued from Court to Court until this present day and now here at this day cause standing for a Tryal came ye Plt by Michael Earle his attry as allsoe ye sd Defendt by his said attry Declar viz. |
