884 Kent fs James Williams otherwise called James Williams late of Talbot County Planter was summoned to Answer to Thomas Bruff Inholder of a plea that he render him the full and just sume of Twelve hundred poundes of good sound Every way well conditioned Tobaccoe in cask which to him he Oweth and from him he unjustly deteineth And wherupon the said Tho by Michael Earle his Att.ry saith that Whereas the sd James on the 27.th day of December Anno Dom 1688 in sd County within the Jurisdicon of this Court by his certain bill or Writing obligatory sealed with his seale as his Act and deed delivered and here into Court brought whose date is the same day and Yeare did himselfe to pay or cause to be paid unto the sd Thomas His Heires Ex.rs Adm.rs or Assignes the sd sume of 1200.ll of Tobaccoe quallified as aforesd convenient in Wey River To the w.ch paym.t well and truely to be made and don he the sd James did bind himselfe his Heires Ex.rs and Adm.rs in the penal sume of Two Thowsand Four hundred poundes of like Tobaccoe as aforesd to be paid as aforesd Yett nothwithstanding the sd James the sd sume of 1200.ll of Tobaccoe according to the Ten.r of the same Bill unto the sd Thomas he hath not paid but the same to pay he hath denied and refused to the damage of the sd Thomas Twenty four hundred poundes of Tobaccoe and therupon he brings this suit Earle p q.r pledges &c.a John Doe Rich Roe And the sd Defend.t by his said Attorney Reads Nil debet p patriam Macklin p Defend.t And the plt in like manner Earle p plt Command was therfore given to the sheerif of Kent County that he cause twelve good and lawfull men of Bailiwick to come before this Court to try the Issue Joyned as above which Jury are
