875 Yett Notwithstanding the aforsd Thomas the aforsd sume of 800.ll of Tobaccoe according to the Ten.r of the same bill unto the aforsd Peter he not paid alltho often demanded but the same to pay he hath denied and refused and still doth deny and refuse to the damage of the sd Peter Peterson the sume of 1600.ll of Tobaccoe and therupon he brings this suit Macklin p q.r pledges &c.a Jn.o Doe Ri Roe And the sd Defend.t comes and prayes Oyer of the Original Writt Burrous in a pria psona which being read the sd Defen by his sd Att.ry pleads Non Est factum p patrium Earle p Deft And y.e Plt by his sd Attorney saith it is his Act and deed and in like manner putts himselfe upon the Country Macklin Command was therfore given to the sheerif to cause Twelve good & lawfull men of his Bailiwick to come before this Court to try the Issue Joyned as above But the sd Plt not willing to proceed to Tryal according to y.e afd Issue Judgm.t is Awarded for a Non suit Therfore it is considered by this Court that the Defend.t Thomas Burrous doe recover from the plt Peter Peterson as well Fifty poundes of Tobaccoe for a Non suit as allsoe the sume of One hundred and Ninety poundes of Tobaccoe cost of suit Simon Wilmer Clk
