Command was given to the sheerif of Kent County the 25.th day
of November Anno Dom 1697 that he take Peter Peterson if he
should be found in his Bailiwick and him safe Keepe soe that he
have his Body before his Maj.ties Justices att the next Court to Answ.r
unto Peter Peterson of a plea y.t he render unto him 800.ll of Tobaccoe

Att which Court viz the 15.th day of Feb.ry Anno Dom 1697 the day
by adjournm.t of returne of sd Writt came Cap.t Edward Sweatnam
high sheerif of sd County and made returne of sd Writt in these
words viz    Cepi Edw Sweatnam sheft

On which sd day came the sd Defend.t by Michael Earle his Att.ry
and Appeares and being served w.th a Coppy of the Decla according
to Act of Assembly in such case made and provided and the sd
cause now standing for Tryal y.e plt declares viz

Kent fs     Thomas Burrous als dict Thomas Burrous late of
                Talbot County Planter was summoned to Answer unto
Peter Peterson of a plea that he render unto him the full and
just sume of Eight hundred poundes of good sound M.rchantable
Tobaccoe in cask w.ch to him he Oweth and from him he
unjustly deteineth &c.a

And whereupon the sd Peter Peterson by Richard Macklin his
Att.ry saith that whereas the sd Thomas on the 17.th day of Feb.ry
Anno Dom 1686/7 att Chester River within the Jurisdicon of this
Court by his certain bill or Writing obligatory sealed with his
seal as his Act and deed delivered and here in Court brought
whose date is the same day and Yeare did obliege himselfe his
Heires Ex.rs Adm.rs and Assignes or Lawfull Att.ry the full and just
^sume or^ quantitiy of 800.ll of Tobaccoe quallified as aforesd and that for a
valuable consideracon in hand allready received and for the well
paymt therof the aforsd Thomas Burrous did oblieg himselfe his
Heires Ex.rs Adm.rs or Assignes to pay the aforesd Peter Peterson his
Heires Ex.rs Adm.rs or Assignes upon demand att or upon the 10th day
of November next Ensueing the date of the same bill according
