On which sd day came the said Defend.t by Richard
Macklin his Att.ry and appeares and prayes therof to
Imparle until the next Court which was granted the
same day is given to the plt allsoe

And now here att this day the sd Cause standing for
Tryal but the Plt not prosecuting his Accon Judgm.t
is Awarded for a Non suit

Therfore it is considered by this Court that the Defd.t
Thomas Screwes doe Recover from the Plt Robert Hurd
as well the sume of Fifty poundes of Tobaccoe for a
Non suit as allsoe the sume of One hundred Fifty and
Eight poundes of Tobaccoe cost of suit

Command was given to the sheerif of Kent County the
28.th day of September Anno Dom 1697 that he take
Thomas Screwes if he should be found in his Bailiwick
and him safe Keepe soe that he have his Body before
his Maj.ties Justices att the next Court to Answer unto
William Hollingsworth of a plea of Trespasse upon the
case &c.a

Att which Court viz the 23.th day of November Anno
Dom 1697 the day of returne of sd Writt came Cap.t Edward
Sweatnam high sheerif of sd County and made returne
of sd Writt in these words viz    Cepi Edw Sweatnam sheft

On which sd day came the sd Defend.t by Richard Macklin his
attorney and appeares and prayes therof to Imparle until the
next Court which was granted the same day is given to the plt
likewise
