870 And now here att this day the sd cause standing for Tryal the sd Plt not prosecuting his Accon Judgm.t is Awarded for a Non suit Therfore it is considered by this Court that the Defd.t Thomas Screwes doe Recover from the plt William Hollingsworth as well the sume of Fifty poundes of Tob for a Non suit as allsoe the sume of One hundred Fifty & Eight poundes of Tobaccoe cost suit S Wilmer Clk Command was given to the sheerif of Kent County the 28.th day of September Anno Dom 1697 that he take Robert Davenish if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the next Court to Answer unto Richard Wallis ^et Uxor^ of a plea of Trespasse upon the case &c.a Att which Court viz the 23.th day of November Anno Dom 1697 the day of returne of sd Writt Cap.t Edw.d Sweatnam high sherrif of said County and made returne of sd Writt in these words viz Cepi Edw Sweatnam sherft And which said day came the said defend.t by Richard Macklin his Att.ry and prayes therof to Imparle until the next Court which was granted the same day is given to the plt likewise And Now here att this day the sd cause standing for tryal came the said Plt by Michael Eare his Att.ry and declareth viz Kent fs Robert Davenish otherwise called Robert Davenish of sd County Planter was sum to Answer unto Richd Wallis and Ann his Wife of a plea wherfore by force and armes of the Bodies of the afd Richard and Ann he the said Robert made an assault and them the sd |
