868 In persuance of a certain Act of Assembly did carry the said Margarett before the Justices of Talbot County Court y.e 18.th day of June &c.a but doth not in his sd declaracon say that a Transcript of the sd Record he is ready here to produce in Court therfore the declaracon vitious for in all Declaracons where matter of Record is insisted upon it ought to be w.th a protest[?] [illegible] in Curia Which reason being Argued and by this Court considered this Court doe give Judgm.t that the said demurrer is good in Law & that the sd Defd.t have a Non suit Therfore it is considered by this Court that the Defend.t William Nelson als Elson doe Recover from the plt John Pemberton as well the sume of Fifty poundes of Tobaccoe for a Non suit as allsoe the sume of Two hundred and four poundes of Tobaccoe cost of suit S Wilmer Clk
Command was given to the sheerif of Kent County the 28.th day of September Anno Dom 1697 that he take Thomas Screwes if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the Next Court to Answer unto Robert Hurd of a plea of Trespasse upon the case &c.a Att which Court viz the 23.th day of August Anno Dom 1697 came Cap.t Edward Sweatnam high sheff of sd County and made return of sd Writt in these words Cepi Edw: Sweatnam sheff |
