867 The sd Margaretts service aforsd the sd William being evilly designed against the said John Plotting and Contriveing him the said John of the service and Labor of her the sd Margaret to hinder disturb and molest att the time and place aforesd the sd William on the Body of the said Margaret one Child not begett And the sd John in fact saith that he in persuance of a certain Act of Assembly in that case made and provided did carry the said Margaret Naylor before the Justices of Talbot County Court viz Cap.t James Murphy and his Associates on the 18.th day of June Ann.o D.o 1697 and then and there she the sd Margaret did upon her corporal Oath declare that the sd William Ellson als Nelson was the true Father of the sd Child Yett Neverthelesse the sd Will.m the Act of Assembly in that behalfe no wayes regarding he then being a Free man satisfaction to the sd John he hath not made alltho often therunto required wherby Accon accrues to the sd John for his damages aforesd Wherupon the sd John saith and to this Court humbly setts forth that thro the coste of the service of her the sd Margaret Naylor and many other great troubles that did arise upon the p.rmises that he the said John the Worse is and damage hath to the value of 3200.ll of Tobaccoe and therupon he brings this suit Earle p q.r pledges &c.a Jn.o Doe Ri Roe
And the sd Plt for Replicacon saith that the declaracon aforesaid is good and sufficient in Law and prayes Judgm.t Earle p plt And the sd Defendt by Richard Mackin his attry saith that according to ye statute of Demurrer 1st That in the Body of the declaracon he infers that ye sd John |
