866 But the sd defend.t Neither by himselfe nor any Att.ry fileing any Plea Judgm.t is Awarded by Nihil Dicit Therfore it is considered by this Court that the plt William Dent doe Recover from the sd Denfend.t Edward Walwyne and and Susanna his Wife Ex.rs as aforesd the sd sume of Fower hundred poundes of Tobaccoe as allsoe the sume of Two hundred Fifty and Four poundes of Tobaccoe cost of suit S Wilmer Clk Command was given to the sheerif of Kent County the 28.th day of September Anno Dom 1697 that he take William Elson if he should be found in his Bailiwick and him safe Keep soe that he have his Body before his Maj.ties Justices att the Next Court to Answer unto Jn.o Pemberton of a plea of Trespasse upon the case Att which Court viz the 23.th day of Novemb.r Ann.o Dom 1697 came Cap.t Edward Sweatnam high sheerif of sd County and made returne of sd Writt in these words viz Cepi Corpus p Edw Sweatnam sheft And now here att this day the sd cause standing for Tryal came the sd Plt by Michael Earle his Att.ry & declareth viz Kent fs W.m Elson otherwise called W.m Elson late of Talbot County stands Attached to Answer unto John Pemb.rton of Talbot County of a plea of Trespasse &c.a And whereupon the sd John by Michael Earle his Att.ry comes and saith that Whereas on the Tenth day of May Anno Dom 1696 att Tuckahoe within the jurisdiction of this court he the plt had and retained unto his Service by In= denture one Margarett Naylor and dureing ^ye terme^ of her |
