Command was Given to the sheerif of Kent County y.e
28.th day of September Anno Dom 1697 that he take
Thomas Joce if to be found in his Bailiwick and him
safe Keepe soe that he have his Body before his Maj.ties
Justices att the next Court to Answer unto William
Bently of a plea of Trespasse upon the case

Att which Court viz y.e 23.th day of Novemb.r Anno Dom 1697
the day of Returne of sd Writt came Cap.t Edward Sweatnam
high sheerif of sd County and made returne of sd Writt in these
words viz    Cepi Edw Sweatnam sheft

And now here att this day the sd cause standing for Tryal came
the sd Plt by Richard Macklin his Att.ry and declareth viz

Kent fs  Thomas Joce of sd County stands Attached to Answer to W.m Bently
of a plea of Trespasse upon the case

And Whereupon the sd W.m by Richard Macklin his Att.ry Complains
that Whereas the sd W.m professing himselfe a planter and
being skilled in the makeing a Crop of Corne and Tobaccoe and other
grain on the 10.th day of March Anno Dom 1695 in sd County within
the Jurisdicon of this Court att the Especial Instance and request
of the sd Thomas was Imployed ^& entertained^ by him the sd Thomas as an Overseer
to work with and take charge of Four hand of the sd Thomas
for the Ensueing Yeare and with them sd hands to make a Crop of
Indian Corn Barly and Tobaccoe the sd William for his Labor &
care in Workeing with directing and lookeing after the sd hands
upon the sd Thomas his Plantacon to have an Equall share of
Tobaccoe with the sd Four hands Two shares of Indian Corne &
One share of Barly that should be made upon the sd Thomas
his Plantacon his Own and his Wives Accomodacon neare

And the sd W.m in fact saith that the several shares &c.a as afore
menconed doth amount to the sume of Two Thowsand Eight
hundred poundes of Tobaccoe In consideracon wherof the sd
Thomas upon himselfe assumes and to the sd W.m saith fully promises
that he the said William should have and receive out of
