864 The sd Crop when finished his proportionable shares of Indian Corne Tobaccoe and Barly Yett Neverthelesse the said Thomas his promise and Assumption ^aforsd^ little regarding but plotting contriveing and fraudulently intending him the sd William in this behalfe craftily and subtilly to deceive and defraud the sd several shares of corne Tobaccoe and Burly aforesd the sd William he would not suffer to have and Receive but the same hath denied and refused and still doth deny and unjustly deteine to the damage of the sd W.m Bently Three Thowsand poundes of Tobaccoe and therupon he brings this suit Macklin p q.r pledg &c.a Jn.o Doe Ri Roe
Earle p Defd.t But the sd Defend.t Neither by himselfe nor by his Attorney makeing any other defence but are willing that Judgm.t shall be Awarded for the sume of 2200.ll of Tobaccoe & cost Therfore it is considered by this Court that the plt William Bently doe recover from the Defend.t Thomas Joce as well the aforesd sume of Two Thowsand Two hundred poundes of Tobaccoe as allsoe the sume of Two hundred Fifty and Five poundes of Tobaccoe cost of suit S Wilmer Clk Command was given to the sheerif of Kent County y.e 28.th day of September Anno Dom 1697 that he take Edward Walwin and Susanna his Wife Ex.rs of Phillip Davis if they should be found in his Bailiwick and them safe Keepe soe that he have their Bodies before his Maj.ties Justices att y.e next Court to Answer unto Wm Dent of a plea of Trespasse upon the case |
