854 And the sd Richard Macklin who prosecuteth for our ds soveraigne Lord the King saith he is guilty Macklin Command was therfore given to the sheft of Kent County that he cause Twelve good and Lawfull men of his Bailiwick to come before this Court to try the Issue Joyned as above which jury are viz
Which Jury being duely sworne to Try the Issue Joyned M.r Thomas Keare & M.r James Wroth sworne as Evidence on his Maj.ties behalfe &c.a The Court and Jury haveing heard the Evidence and pleadings on both sides the Court giveth the jury their charge who withdrraw some time to consider on the premises and after some time doe returne and being called over as allsoe the sd Hugh Marsh the sd jury by their Foreman doe say that the sd Hugh Marsh is not guilty as he stands indicted And the sd Hugh Marsh in his proper person moves this Court that he may be cleared by proclamacon which is Accordingly performed S Wilmer Clk And the sd M.r Richard Macklin comes into Court and moves that the sd Hugh Marsh may find security for his good behavior and appearance att the next Court which is by this Court accordingly Ordered S Wilmer Clk |
