849 Court adjournes for halfe an hour y.e same Court sitts againe Thomas Smith as Overseer of the high waies on the south side of Chester River was in November last presented by the Grand Jury Command was therfore Given to the sheerif of Kent County the 25.th day of November Anno Dom 1697 that he cause the sd Thomas Smith soe that he be and appeare before his Maj.ties Justices att y.e next Court to Answer &c.a Att which Court viz the 15.th day of February the day of Returne of sd Writt came Cap.t Edward Sweatnam high sheerif of sd County and made Returne of sd writt in these words Cepi p Edward Sweatnam sheeft And now here att this day the sd Thomas Smith being called to Answer y.e sd presentm.t (being by the Clk of the Indictm.ts formed into a Bill of Indictm.t) now appeares and the sd Bill being read in these words viz Kent fs The Jurors for our soveraigne Lord the King upon their Oathes doe present Thomas Smith otherwise he the sd Thomas Smith of sd County Planter for that he the sd Thomas att Island Creek hundred within the Jurisdicon of this Court being appointed overseer of y.e high wais p order of sd Court to Cleare the Roades in the sd hundred and haveing Warr.t to him Issued for y.e same hath now to this day viz the 23.th day of November Anno Dom 1697 Neglected to doe the same contrary to the Law which case made and Provided Macklin p Dom Rege Signed Billa Vera John Chaire Foreman |
