And Whereupon the sd John by Richard Macklin his Att.ry
complains that Whereas the sd Charles on the 12.th day of November
Anno Dom 1696 att Chester River within the Jurisdicon of this
Court att the Especial instance and request of him the sd Charles
the sd John did deliver unto him the sd Charles by the way of
loane One New shallop Twenty four ^foote^ by the Keele with good
new sailes good standing and runing Rigging with Cable and
anchor all of the value of Twenty and Four poundes curr.t money
of England to the ondly and proper use of him the said Charles
Webb and his service to Carry and bring goods Wares and M.rchandizes
betweene the sd Chester River and a certain Patuxent River
to be returned by the sd Charles to the sd John Hawkins att or before
the 28.th day of December then next following the delivery therof
In consideracon therof the sd Charles upon himselfe assumed and to
the sd John faithfully promised that he the sd Charles the sd shallop
sailes and Tackling aforsd unto the said John att Chester River
aforesd and att or before the time aforesd would well and safely
Redeliver Yett Neverthelesse the sd Charles his promise and assumcon
little regarding but plotting contriveing and fraudulently intending
him the sd John in this behalfe craftily and subtilly to
deceive and defraud the sd shallop with Rigging sailes and
other the Tacklin unto the sd John he hath not redelivered but
the same to doe he hath denied & Refused and as Yett denieth and
refuseth to the damage of the sd John Hawkins Fifty poundes
sterl and therupon he bringeth this suit
                                    Macklin p q.r pledg &c.a Jn.o Doe Ri Roe

And the sd Defend.t by Michael Earle his Att.ry produceth to this
Court a Habeas Corpus cum causa for Transmitting y.e said
accon to the Provintial Court
