837 Command was given to the sheerif of Kent County the 28.th day of September Anno Dom 1697 that he take Hugh Marsh if he should be found in his Bailiwick & him safe Keepe soe that he have his Body before his Maj.ties Justices att the next Court to Answer unto Sarah Toaes Daniel and John Toaes of a plea of Tresp upon the case Att which Court viz the 24.th day of November Anno Dom 1697 the day of Returne of sd Writt came Cap.t Edward Sweatnam high sheerif of sd County and made Returne of sd Writt in these words Cepi Corpus p Edw Sweatnam sheft On which said day the sd Defend.t by Michael Early his Att.ry appeares and being served with a Coppy of the declaracon According to Law in such case made and provided And now here att this day viz the 24.th day of November the said cause standing for Tryal came as well the said Defd.t by his said Attorney as allsoe the Plts by William Hemsley their Attorney and declr viz
And Whereupon the said Sarah Daniel and John by W.m Hemsley their Att.ry complain that Whereas the said Hugh on the 10.th day of October Anno Dom 1697 att Chester River within the Jurisdicon of this Court stood justly indebted unto them the sd Sarah Daniel and John the full and just sume of Tenn Thowsand pounds of Tobaccoe or the value therof in Wheat and Indian Corne to witt Wheat att Fifty poundes of Tobaccoe p Bushel and Indian Corne att Twenty poundes of Tobaccoe p Busshel it being the Third paym.t to be made by him the said Hugh unto them |
