831 And the sd Michael Earle Att.ry of the sd Defend.t comes into Court and pleades Non Sum Informatus Therfore it is considered by this Court that the Plt Edward Daw doe Recover from the Defend.t Richard Chapman as well the aforesd sume of Fourteen hundred sixty and ^Eight^ poundes of Tobaccoe as allsoe the sume of Two hundred Forty and Nine poundes of Tobaccoe cost of suit S Wilmer Clk Command was given to the sheerif of Kent County the 10.th day of September Anno Dom 1697 that he take John Tidings if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att y.e next Court to Answer unto John Browne Jun.r of London M.rchant and Comp.a of a plea of Trespasse upon the case Att which Court viz the 28.th day of September Anno Dom 1697 the day of returne of sd Writt came Cap.t Edward Sweatnam high sheerif of sd County and made returne of sd Writt in these words Cepi Corpus p Edward Sweatnam sheft On which day the sd Defend.t appeares in his proper person and prayes thereof to Imparle until the next Court which was granted the same day is given to the plt likewise And now here att this day viz the 24.th day of November Anno Dom 1697 came the sd Plt by Richard Macklin his Attorney and declar viz
a plea of Trespasse upon the case/ And whereupon the sd plts by Richard Macklin their Att.ry complains that Whereas the sd Jn.o Tidings on the 20.th day of November Anno Dom 1696 in sd |
