Richard Chapman and for the debt of him the said Richard
Chapman by One certain bill or Writing obligatory did beco
bound and oblieged together with him the sd Richard to a certain
John Finnett in the sume of Eleaven hundred poundes
of Tobaccoe to be paid to him the sd John Finnett upon the 10.th
day of October then next Ensueing the date of the same bill
on consideration therof the aforsd Richard on the 24.th day of
August 1695 att Calvert County aforsd did upon himselfe
assume to him the said Edward did then and there faithfully promise
that he the sd Richard the sd Edward from the sd bill
or Writing obligatory and of and from the sd 1100.ll of Tobaccoe
in the sd Bill contained and allsoe from all such att Law ag.t him
the sd John Finnett would discharge and save harmlesse Yet
Neverthelesse the aforesd Richard Chapman her promise and assumpcon
aforesd little weighing or regarding but plotting contriveing &
fraudulently intending him the sd Edward in that behalfe craftily
and subtilly to deceive and defraud the aforesd 1100.ll of Tobaccoe
unto the sd John Finnett he hath not paid nor him the sd Edward in
any manner ag.t him the sd John Finnett of the aforesd sume of
1100.ll of Tob according to his promise and assumpcon aforesd
hath not hitherto discharged or save Harmelesse Alltho the sd Edw.d
hath many times requested the sd Richard to pay the sd sume
of Tobaccoe unto the sd M.r Finnett And the said Edward in fact saith
that by reason of the sd Richards failure of paym.t of the aforesd sume
of 1100.ll of Tobaccoe unto the sd John Finnett the sd John Finnett att
Calvert County hath sued the sd Edward in the sd County Court for y.e sd
sume of 1100.ll of Tobaccoe for which the sd Edward was bound w.th y.e sd
Richard unto the sd John Finnett and hath recovered the same ag.t
him the sd Edward togeather with 368.ll of Tobaccoe cost of suit by
the sd Court adjudged whereby Accon did Accrue to the sd Edward
to have & require from the sd Richard the like sume of 1468.ll of Tobacco
being the aforesd Debt and cost of suit Yett Notwithstanding the sd
Richard the sd sume of 1468.ll of Tobaccoe the Debt and cost aforesd
alltho often demanded unto the sd Edward Daw he hath not paid but y.e
same to pay he hath denied and refused & as Yett doth deny and refuse to the
damage of the sd Edward 2000.ll of Tob and therupon he brings this suit
