829 Therfore it is considered by this Court that the plt Hugh Marsh doe Recover from the Defend.ts Sarah Toaes Daniel and John Toaes the sume of One hundred Thowsand poundes of Tobaccoe as allsoe the sume of six hundred Ninety and One poundes of Tobaccoe cost of suit from which sd Judgm.t the said Defd.ts Appeare Michael Miller and James Smith beco bound for psecuting the same S Wilmer Clk Command was given to the sheerif of Kent ^County^ the Tenth day of September Anno Dom 1697 that he take Richard Macklin if he should be found in his Bailiwick and him safe Keepe & that he have his Body before his Maj.ties Justices att y.e Next Court to Answer unto Edward Daw of a plea of Tres upon the case Att which Court viz the 28.th day of September Anno Dom 1697 the day of Returne of sd Writt came Capt Edward Sweatnam high sheerif of sd County and made Returne of sd Writt in these Words Cepi Edw Sweatnam sheft On which sd day the sd Defend.t by Michael Earle his Att.ry appeares and prayes therof to Imparle until next Court which was granted the same day is given to the Plt likewise And now here att this day viz the 24.th day of November Anno Dom 1697 came as well the sd Plt by Richard Macklin his Att.ry as allsoe the sd Defend.t by his said Attorney and the sd cause now standing for Tryal declr viz
And whereupon the sd Edward by Richard Macklin his Att.ry sais that wheras he the said Edward att Calvert County within y.e Jurisdicon of this Court on the 24.th day of August Anno Dom 1695 att the Especial instance and request of him the said Richard |
