825 And the sd sd plts in fact saith that trusting to the fair promises and Assumption ^aforesd^ of him the sd John Tidings did deliver to him the sd John Tidings the sd certain pair of stilliards of the value aforesd Yett Neverthelesse the sd John Tidings his promise and Assumption aforesd little regarding but plotting contriveing and fraudulently intending them the sd plts in this behalfe craftily and subtilly to deceive and defraud the sd pair of stilliards unto the sd plts he hath not redelivered alltho often demanded but the same to redeliver he hath denied and still doth deny and unjustly detein to the damages of the sd Plts Five hundred poundes of Tobaccoe and therupon they bring this suit Macklin pr q.r pledg &c.a Jn.o Doe Ri Roe But the sd Defend.t not fileing any plea to y.e above decld Judgm.t is Awarded According to Ten.r of the same Therfore it is considered by this Court that the plts John Browne Jun.r and Company m.rch.ts doe Recover from the Defend.t John Tidings the above menconed stilliards as allsoe the sume of Two hundred Seaventy & Three poundes of Tobaccoe cost of suit S Wilmer Clk Command was given to the sheerif of Kent County the 10.th day of September Anno Dom 1697 that he take Sarah Toaes Daniel and John Toaes als dicts &c.a if they should be found in his Bailiwick and them safe Keepe soe that he he have their Bodies before his Maj.ties Justices att the next Court to answer unto Hugh Marsh of a plea that they Render &c.a Att which Court viz the 28.th day of September Anno Dom 1697 the day of Returne of sd Writt came Cap.t Edward Sweatnam high sheerif of sd County and made Returne of sd Writt in these words Cepi p Edw Sweatnam sheft On |
