824 Command was given to the sheerif of Kent County y.e 10.th day of September Anno Dom 1697 that he take John Tidings if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the next Court to Answer unto John Browne of London M.rcht and Comp.a of a plea of Trespasse upon the case Att which Court viz the 28.th day of September Anno Dom 1697 the day of returne of sd Writt came Capt Edward Sweatnam high sheerif of sd County and mad returne of sd writt in these Words viz Cepi Corpus p Edward Sweatnam sheft On which sd Day the sd Defend.t in his proper person appears and prayes therof to Imparle until next Court which was granted the same day is given to the Plt likewise And now here att this day viz the 24.th day of November Anno Dom 1697 came the sd Plt by Richard Macklin his Attorney and the said cause standing for Tryal declares viz
of a plea of Trespasse upon the case And Whereupon the sd plts by Richard Macklin their Atto.ry complains that Whereas the sd John Tidings on the 17.th day of Novemb.r Anno Dom 1696 in sd County within the Jurisdicon of this Court att the Especial instance and request of him the sd Jn.o Tidings that if they the sd plts would deliver unto him y.e sd Jn.o Tidings a certain pair of stilliards of the value of Three hundred poundes of Tobaccoe he the sd Jn.o Tidings ^did^ then and there upon himselfe assume and to y.e sd plts faithfully pomised that he the sd John Tidings the same stilliards safe and in good Order without any damage to the sd plts would well and Faithfully deliver when therunto required and |
