Att which Court viz the 24.th day of August Anno Dom 1697
the day of returne of sd writt came Capt Edward Sweatnam high
sheerif of sd County and made returne of sd writt in these words
viz Cepi Corpus p Edw Sweatnam sheft

On which day the Defend.t by Michael Earle his Atto.ry appeares but
the Pltfs by William Hemsley their Attorney moves this Court that the
sd Defend.t may put ^in^ Especial Bail to the sd Accon which being by this
Court overruled p the sd Defend.t by his sd att.ry prayes therof to Imparle
until the Next ^Court^ which was granted the same day is given to
the Pltfs likewise

Which said cause being continued from Court to Court until this
present day

And now here att this day viz the 24.th day of November Anno
Dom 1697 the sd Cause standing for Tryal came as well the sd Pltfs
by their sd Attorney as allsoe the Defend.t by his sd Attorney and the
pltfs declares viz

Sarah Daniel and John Toaes

Kent fs Hugh Marsh of Kent County
Miller stands Attached to Answer unto
Sarah Daniel and John Toaes of a plea of Trespasse upon the Case

And whereupon the sd Sarah Daniel and John by William Hemsley
their Attorney complaineth that whereas the sd Hugh Marsh on y.e
10.th day of October Anno Dom 1696 att Chester River within the
Jurisdicon of this Court stood justly indebted unto them the sd
Sarah Daniel and John the full and just sume of Tenn Thowsand
poundes of Tobaccoe or the value therof in Indian Corne and
Wheat viz Wheat att Fifty poundes of Tobaccoe p Bushel &
Indian Corne att Twenty poundes of Tobaccoe p Bushel it being
the second payment to be made by him the sd Hugh unto them
the sd Sarah Daniel and John for a certain Water Mill with the
appurtnances therunto belonging and a Plantacon sould unto
him the sd Hugh by them the sd Sarah Daniel and John In consideracon
wherof the sd Hugh upon himselfe assumed and to the
sd Sarah Daniel and John faithfully promised that he the sd Hugh
the sd sume of Tenn Thowsand poundes of Tobaccoe or the value
therof in ^Wheat and^ Indian Corne att the rates aforesd unto the sd Sarah Daniel
and John would well and truely pay when therunto required
