Yett Neverthelesse the sd Hugh his promise and Assumption
aforesd little regarding but seekeing and intending them y.e
said Sarah Daniel and John craftily to deceive the sd sume
of 10000.ll of Tobaccoe or the value therof as aforesd he hath
not ^paid^ alltho often demanded but the same to pay he hath
denied and refused and still doth deny and refuse to the damage
of them the sd Sarah Daniel and John the sume of
Eight Thowsand poundes of Tobaccoe besides the matter
in hand and therupon they bring this suit

And the sd Defend.t by Michael Earle his Att.ry
comes and defends the force and Injury when &c.a &
for plea saith that the declr of the said Sarah Daniel and John Toaes
and the Matter therin contained is not sufficient in Law for them
the sd Plts to have and maintaine their Accon ag.t him the sd Defd.t
and that the sd Defd.t hath no Necessity nor by the Law of the Land
is he bound to Answer all which he is ready to Aver therfore for
want of a sufficient declr in this behalfe and sufficient matter
therin to be contained he the sd Defend.t prayed Judgm.t together
with his costs to be adjudged unto him by this Court heere Earle p Defd.t

1.st rea    The plts in their declr doth alledge y.e Defend.t stands Justly indebted
                to them in the full and just sume of Tenn Thowsand poundes
                of Tobaccoe or the value therof in Indian Corne and Wheat &c.a but
                doth not declare how the sd Deft stands indebted to them the sd Plts
                the sd sume of Tobaccoe &c.a wether by Bill Bond Acc.o or otherwise
                so that the sd Defend.t Knoweth not how to put in a certain Answer

2.d reas    If the sd Plts declare upon an account then the said account
                should have been filed with their Declr that the sd Defend.t might
                have Knowne how to Answered but if upon an obligacon then the sd
                Plts should have mentioned their obligacon that then the Defend.t
                might have craved Oyer therof and Knowne how to have answer
                the same
