797 Which Demurrer being Argued and by this Court duely considered Judgm.t is Awarded that the sd Demurrer is good in Law Whereupon the sd Defend.t by Richard Macklin his Atto.ry moves this Court for a Non suit which is accordingly granted Therfore it is considered by this Court that the Defend.t Cap.t Edward Sweatnam doe Recover from the Plt Perigrine Browne as well the sume of Fifty poundes of Tobaccoe for a Non suit as allsoe the sume of One hundred Ninety and Eight poundes of Tob cost of suit Simon Wilmer Clk
Command was Given the sheerif of Kent County the 23.th day of June Anno Dom 1697 that he take Charles Hollingsworth Jun.r if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the Next Court to Answer unto John Em.rson Ex.rs of Warner Sudal of a plea that he Render him &c.a Att which Court viz the 24.th day of August Anno Dom 1697 Sweatnam high sheerif of sd County and made returne therof in these Wordes viz Cepi p me Edw Sweatnam sheft On which day came the sd Defend.t Charles Hollingsworth by Richard Macklin his Attorney and prayes therof to Imp.rl until the Next Court which was granted the same day is given to the Plt likewise And Now here att this day viz the 28.th day of September Anno Dom 1697 came as well the sd Plt by Michael Earle his Attorney as allsoe the sd Defd.t by Richard Macklin his Att.ry |
