late of Talbot County planter was summoned to Answer unto
John Emerson Ex.r of the last will and Testament of Warner
Sudal late of sd County Decead of a plea that he render him
the full and just sume of Four hundred poundes of good sound
M.rchantable leafe Tobaccoe and caske which to him in his sd
capacitie he Oweth and from him he unjustly detains

And Whereupon the sd John in his sd capacity by Michael Earle
his Att.ry saith that whereas the sd Charles the 10.th day of Feb.ry
Anno Dom 1694 in sd County within the Jurisdicon of this Court
by his certain Bill or Writing obligatory sealed with his seale as
as he Act and deed delivered and here in Court brought whose
date is the same day and Yeare did bind himselfe his Heires Ex.rs
and Adm.rs to pay or cause to be paid unto the sd Warner Sudal his
Heires Ex.rs Adm.rs or assignes the aforesd sume of 400.ll of Tobaccoe
quallified as aforesd convenient in the aforesd County of Talbot
att or upon the Tenth day of October next ensueing the date
of the same Bill yett Notwithstanding the aforesd Charles the
aforesd sume of 400.ll of Tobaccoe according to the Ten.r of the
same Bill unto the sd Warner Sudal in his life time he hath not
paid nor unto the sd John in his ^sd^ capacity since the death of the
sd Warner Sudal he hath not paid alltho often therunto required
but the same to pay he hath denied and refused and still doth
deny and refuse and unjustly deteine to the damage of the
sd Testators Estate 800.ll of Tobaccoe and therupon the sd John in
his sd Capacity b.rings this suit and here in Court brings his
Letters Testamentary Earle p q.r pledges &c.a Jn.o Doe Ri Roe
