unto Perigrine Browne and Comp.a M.rchants of a plea that he Render them the full and just sume of Two Thowsand four hundred and Seaventeen poundes of sound bright and every way well condiconed Tobaccoe in cask which to them he Oweth and from them he unjustly deteineth And whereupon the sd Plts by William Hemsley their Attorney saith that Whereas the sd Edward on the 29.th day of July Anno Dom 1690 in sd County within the Jurisdicon of this Court by his certain bill or Writing obligatory sealed with his seale as his Act and Deed delivered and here in Court brought whose date is the same day & Yeare did bind himselfe his Heires Ex.rs & Adm.rs to pay or cause to be paid unto the sd Plts their certain Attorney Ex.rs or Assignes the sd sume of 2416.ll of Tobaccoe quallified as aforesd Yett Neverthelesse the sd Edward the sd sume of 2416 pounds of Tobaccoe according to the Ten.r of the same Bill unto the sd Plts he hath not paid alltho often demanded but the same to pay he hath denied and refused to the damage of the sd Plts Four Thowsand poundes of Tobaccoe and therupon he brings this suit Hemsley p q.r Pledges &c.a John Doe Rich Roe
Demurs in Law and for cause of Demurrer saith that the Accon is brought by the Attorney of Perigrine Browne ondly who hath not sufficient power from Browne and Comp.a to whome the Bill is passed to discharge him the sd Defend.t |
