Yett Neverthelesse the sd William the said sume of 7751.ll
poundes of Tobaccoe according to his promise and Assumption afd
in his life time nor the said Mary when sole and unmarried Nor
the said Amos and Mary to whom Letters of Adm.rn of said intestate
his Estate was committed nor either of them in their several capacities
unto the said Simon they have not paid alltho often demanded but
the same to pay they have denied and refused to the damage of the
said Simon Tenn Thowsand poundes of Tobaccoe and therupon he
brings this suit

Plea Debts of an higher Nature out which
ought to be first sattisfied Macklin p Defd.ts

And the sd Plt by W.m Hemsley his Attorney makes it appeare
to this Court that the debts due from sd intestate his Estate are
but inconsiderable therto therfore Judgm.t is Awarded for sd sume
of 7751 1/2.ll of Tobaccoe

Therfore it is considered by this Court that the Plt Simon Wilmer
doe Recover from the said Defend.ts Amos Chadburne and Mary
his Wife in their Capacities the sd sume of Seaven Thowsand Seaven
hundred Fifty One poundes and halfe a pound of Tobaccoe

Command was given to the sheerif of Kent County the 26.th day
of March Anno Dom 1697 that he take Robert Davenish if he should be
found in his Bailiwick and him safe Keepe soe that he have his body
before his Maj.ties Justices att the next Court to Answer unto Richard Wallis
of a plea of Trespasse upon the case

Att which Court viz the 22.th day of June Anno Dom 1697 the day of
Returne of sd Writt came Capt Edward Sweatnam high sheft of sd
County and made Returne of sd Writt in these word viz Cepi Corpus p
me Edw Sweatnam sheft

On which day came the said Defend.t by Richard Macklin his Attorney
and appeared and prayed therof to Imparle which was granted the same
day is Given to the plt allsoe

And now here att this day viz the 25.th day of August Anno Dom
1697 came the said plt by William Hemsley his Attorney as allsoe
the sd Defend.t by Richard Macklin his sd Attorney & said cause standing
                                                                        for Tryal
