Command was given to the sheerif of Kent County the 26.th day of March Anno Dom 1697 that he take Amos Chadburne and Mary his Wife Adm.rs of William Jones if they should be found in his Bailiwick and them safe Keepe soe that he have their Bodies before his Maj.ties Justices Justices att the next Court to Answer unto Simon Wilmer of a plea of Trespasse upon the case Att which Court viz the 22.th day of June Anno Dom 1697 (came Cap.t Edward Sweatnam high sheerif of said County) being the day of returne of sd Writt and made returne therof in these words viz Cepi Corpora p Edw Sweatnam sheft On which day came the sd Defend.ts and p Richard Macklin their Attorney and Appeared and prayed therof to Imparle until the next Court which was granted the same day was given to the plts likewise And now here att this day viz the 25.th day of August Anno Dom 1697 came as well the sd plt by W.m Hemsley his Attorney as allsoe the said Defend.ts p Richard Macklin their sd Attorney and the said cause standing now for Tryal
unto Simon Wilmer of a plea of Trespasse upon the case And wherupon the said Simon by W.m Hemsley his Attorney complaineth that wheras the said W.m Jones on the 26.th day of December Anno Dom 1696 in sd County within the Jurisdicon of this Court stood justly indebted unto the said Simon in the full and just sume of Seaven Thowsand Seaven Fifty and One poundes and halfe a pound of being the Ballance of Accompt the perticulers therof here in Court brought in consideracon wherof the said William upon himselfe assumed and to the sd Simon he faithfully promised that he the sd William the sd sume of 7751 1/2 poundes of Tobaccoe unto the sd Simon would well and truely pay when therunto required Yett |
